Section 1

Acceptance of Terms

By accessing or using OmicsPlot โ€” including any of its tools, APIs, or related services (collectively, the "Service") โ€” you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a binding agreement between you and OmicsPlot LLC, a North Carolina limited liability company currently in formation ("OmicsPlot," "we," "us," or "our"). References to "OmicsPlot LLC" in these Terms refer to that entity once formed; until formation is complete, the Service is operated by the founder of OmicsPlot LLC in their individual capacity, and all rights, obligations, and protections in these Terms apply to that operator.

Section 2

Who Can Use OmicsPlot

OmicsPlot is available to anyone who agrees to these Terms. You must be at least 13 years old to use the Service. OmicsPlot is designed for research, educational, and scientific use and is most appropriate for users 18 and older. If you are under 18, you represent that you have obtained any required parental or institutional consent, and that you are accessing the Service in an educational or supervised research context.

If you are using OmicsPlot on behalf of an institution, laboratory, or organization, you represent that you have authority to bind that entity to these Terms.

OmicsPlot is primarily designed for users in the United States. Users outside the United States access the Service at their own risk with respect to compliance with local laws. We make no representation that the Service complies with the laws of any jurisdiction outside the United States.

Section 3

What OmicsPlot Is

OmicsPlot is a web-based bioinformatics visualization platform. It allows researchers to upload gene expression data, generate publication-quality figures (volcano plots, heatmaps, GO enrichment plots), and build multi-panel figures.

Important โ€” not for clinical use, and not a substitute for scientific validation: OmicsPlot is a research visualization tool. It is not a medical device, is not FDA-cleared or approved, and is not intended for use in clinical diagnosis, treatment decisions, or patient care. OmicsPlot renders the data you provide โ€” it does not validate whether that data is scientifically correct, properly processed, or appropriately interpreted. You are responsible for ensuring your input data and the conclusions you draw from any generated figures are scientifically sound. Results should always be independently validated before use in publications, grant applications, or any other scientific communication.

Not a medical device or professional healthcare service. The Service is provided as a general-purpose data visualization tool. It does not constitute a "medical device" as defined by the Federal Food, Drug, and Cosmetic Act (21 U.S.C. ยง 321(h)), nor does it constitute the "practice of medicine," the provision of "professional healthcare services," or the rendering of any clinical, diagnostic, or therapeutic advice in any jurisdiction. OmicsPlot LLC is not a covered entity under HIPAA and does not assume any obligations as a healthcare provider or medical device manufacturer.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

Section 4

User Accounts

Some features of OmicsPlot โ€” including saving presets, panels, and figure layouts โ€” require a free account. Accounts are created via GitHub or Google OAuth. We receive basic profile information (name, email, profile picture) from your OAuth provider; we do not receive or store your password.

You are responsible for:

  • Maintaining the security of your account and OAuth credentials
  • All activity that occurs under your account
  • Notifying us immediately at admin@omicsplot.com if you suspect unauthorized access

You may not create accounts for others without their consent, or use automated means to create accounts.

Section 5

Your Data

You own your data. When you upload a file or create content in OmicsPlot, you retain full ownership of that content. You grant OmicsPlot LLC a limited, non-exclusive license to process and store your content solely for the purpose of providing the Service to you.

Uploaded files (CSV, TSV, XLSX): Files you upload for analysis are processed server-side to generate your plots and are automatically and permanently deleted within 24 hours of your session ending. We do not analyze, sell, share, or use your uploaded research data for any purpose other than generating your requested output.

Saved content (presets, figure panels, slides): Content you explicitly save to your account is stored in our database and retained until you delete it or delete your account. This includes plot presets, figure builder layouts, and analysis settings.

Figure Builder panels: Plot images saved to the Figure Builder are stored locally in your browser (IndexedDB) and are not transmitted to or stored on OmicsPlot servers, unless you explicitly export them. Clearing your browser data will remove these locally stored panels.

Sensitive data: OmicsPlot is not HIPAA-compliant and should not be used to process data that contains personally identifiable information (PII), protected health information (PHI), or any data subject to regulatory protections such as HIPAA, FERPA, or ITAR. Do not upload patient data, clinical records, or personally identified genomic data.

Human-derived data: Users are strictly prohibited from uploading any human-derived biological data โ€” including but not limited to genomic sequences, transcriptomic profiles, proteomic data, or any other data derived from human subjects โ€” that has not been fully de-identified or pseudonymized in accordance with applicable institutional review board (IRB) requirements, informed consent agreements, and all relevant federal, state, and institutional legal standards. If you are unsure whether your data has been sufficiently de-identified, consult your institution's IRB or data governance office before uploading.

Browser environment security: Figure Builder panels are stored in your browser's local storage (IndexedDB). You are solely responsible for the security of your browser environment, including the management of browser extensions and plugins that may have access to your local browser storage. Browser extensions with broad permissions โ€” including but not limited to shopping assistants, productivity tools, or developer utilities โ€” may be able to read locally stored data. OmicsPlot LLC is not responsible for data accessed by third-party browser extensions or plugins installed in your browser.

Section 6

Acceptable Use

You agree not to use OmicsPlot to:

  • Upload or process data that contains personal health information, patient records, or other regulated sensitive data
  • Violate any applicable law or regulation
  • Attempt to reverse engineer, decompile, or extract the source code of OmicsPlot
  • Intentionally overload or disrupt the Service (e.g., automated bulk requests, denial-of-service attacks)
  • Attempt to gain unauthorized access to other users' data or accounts
  • Use the Service to generate, distribute, or facilitate harmful, illegal, or misleading content
  • Misrepresent your identity or impersonate any person or organization
  • Scrape, crawl, or index the Service without prior written permission

We reserve the right to suspend or terminate access for violations of this section without notice.

Section 7

Research Misconduct

OmicsPlot is intended to support honest scientific inquiry. You agree not to use OmicsPlot to:

  • Fabricate, falsify, or manipulate scientific figures, data, or results in any way that misrepresents your research
  • Generate figures intended to deceive peer reviewers, editors, funding agencies, institutional review boards, or any other scientific or regulatory body
  • Selectively alter, crop, or recolor plots in ways that misrepresent the underlying data

If we receive a credible allegation or are legally required to cooperate with an investigation into research misconduct involving OmicsPlot, we reserve the right to provide relevant records to authorized institutional or governmental investigators in accordance with applicable law.

We have no ability to independently detect research misconduct and make no representations about the scientific integrity of outputs generated by users. Responsibility for the honest use of OmicsPlot rests entirely with the user.

Section 8

Intellectual Property

The OmicsPlot platform, including its code, design, branding, and documentation, is owned by OmicsPlot LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute any part of the Service without prior written permission.

Your output is yours. Figures, plots, and exports you generate using OmicsPlot from your own data are yours. We make no claim to ownership of your research outputs.

Open source code. If OmicsPlot's source code is made publicly available (e.g., on GitHub), it will be released under a separate open source license (such as MIT or Apache 2.0) that governs the code itself. The open source license applies to the code only โ€” it does not modify these Terms, which govern your use of the hosted service at omicsplot.com. The hosted service and the open source code are legally distinct. Any open source release will include a prominent disclaimer in the repository README and LICENSE file consistent with these Terms: that the software is for research use only, is not a medical device, is provided AS IS, and all outputs must be independently validated.

If you publish research that used OmicsPlot in its analysis or figure preparation, we encourage (but do not require) you to acknowledge OmicsPlot by name and URL. Citation details will be posted at omicsplot.com/contact when a formal publication is available.

Section 9

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or available at any particular time
  • Results generated by OmicsPlot are scientifically accurate or appropriate for your specific use case
  • The Service will meet your specific research requirements
  • Any defects or errors will be corrected

You are solely responsible for validating the accuracy of any outputs and for any decisions made based on those outputs.

Third-party open-source libraries. OmicsPlot uses third-party open-source libraries for data processing and visualization โ€” including but not limited to Plotly, D3.js, SciPy, NumPy, seaborn, and matplotlib. We do not warrant the mathematical, statistical, or computational accuracy of these third-party components. A bug or error in an upstream library could potentially cause incorrect rendering, transposed data, or inaccurate statistical calculations without any visible indication of failure. You are responsible for independently verifying the correctness of all outputs, particularly for any quantitative results used in research conclusions.

Responsibility for input data and interpretation. OmicsPlot is a visualization tool. It renders what you give it. We make no representation that any plot, figure, or analysis generated by OmicsPlot accurately represents the underlying biology, correctly reflects your experimental design, or is free of errors introduced by your input data. Specifically:

  • You are solely responsible for ensuring your uploaded data is correctly formatted, properly normalized, and scientifically appropriate for the analysis you are performing.
  • OmicsPlot does not validate whether your fold change values, p-values, gene identifiers, or any other inputs are biologically meaningful or correctly derived from your experiment.
  • A plot that renders without error is not a guarantee that the underlying data or its interpretation is correct.
  • You are solely responsible for verifying that any figures you generate accurately represent your data before including them in publications, presentations, grant applications, or any other scientific or professional communication.
  • OmicsPlot LLC cannot be held liable for errors, misrepresentations, or retractions arising from incorrect data, incorrect interpretation of outputs, or misuse of the visualization tools.

If you are unsure whether OmicsPlot is appropriate for your specific analysis, consult a qualified bioinformatician or statistician before relying on its outputs.

Section 10

Limitation of Liability

To the fullest extent permitted by applicable law, OmicsPlot LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

  • Loss of data or research results
  • Errors or inaccuracies in generated figures or analyses
  • Incorrect, misleading, or misinterpreted scientific conclusions drawn from OmicsPlot outputs
  • Alleged scientific inaccuracies or misrepresentations in visualizations, including claims arising from downstream use in publications, grant applications, presentations, or regulatory filings
  • Retractions, corrections, editorial sanctions, or reputational harm arising from figures generated using OmicsPlot
  • Any outcome resulting from incorrect, improperly processed, or misformatted input data
  • Losses or damages arising from errors in third-party open-source libraries used by the Service
  • Service downtime, interruptions, or data loss caused by force majeure events or third-party infrastructure failures
  • Unauthorized access to your data arising from compromise of your OAuth provider, device, or browser environment

In no event shall OmicsPlot LLC's total liability to you exceed one hundred dollars ($100.00) or the total amount you paid to OmicsPlot in the twelve months preceding the claim, whichever is greater. As OmicsPlot is currently provided free of charge, this cap is $100.00. If paid features are introduced in the future, this section will be updated accordingly.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above may not apply to you.

Section 11

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless OmicsPlot LLC and its members, officers, employees, agents, and successors from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees and court costs) arising out of or relating to:

  • Your access to or use of the Service
  • Your violation of any provision of these Terms
  • Your violation of any applicable law, regulation, or third-party right (including intellectual property rights or privacy rights)
  • Any data you upload, submit, or process through the Service
  • Any figures, outputs, or exports you generate using the Service and how you use or distribute them
  • Any claim that your use of OmicsPlot caused harm to a third party, including but not limited to claims arising from research misconduct, scientific fraud, or misrepresentation
  • Your breach of any representation or warranty made in these Terms

OmicsPlot LLC reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with us in asserting any available defenses. You may not settle any claim subject to indemnification without OmicsPlot LLC's prior written consent.

Section 12

Security Risks & Limitations

We implement industry-standard security measures including HTTPS/TLS encryption, row-level database security, and session isolation. However, no method of data transmission or storage over the internet is completely secure. By using OmicsPlot, you acknowledge and accept the following inherent risks:

  • Data in transit: While all connections to OmicsPlot use HTTPS encryption, we cannot guarantee that data transmitted to our servers is never intercepted, particularly on compromised networks. Do not upload data that you cannot afford to have intercepted.
  • Account compromise via OAuth: If your GitHub or Google account is compromised, an attacker may be able to access your OmicsPlot account. OmicsPlot LLC is not liable for unauthorized account access that originates from a breach of your OAuth provider or your own device. Enable two-factor authentication on your OAuth provider account.
  • Shared and institutional computers: If you use OmicsPlot on a shared, lab, or institutional computer, you are responsible for signing out after each session. OmicsPlot LLC is not liable for unauthorized access to your account or data by other users of the same device.
  • Browser-stored data: Figure Builder panels and slides are stored locally in your browser's IndexedDB. If your device is compromised by malware or accessed by another user, this locally stored data may be exposed. OmicsPlot LLC is not responsible for the security of data stored in your browser.
  • Data loss from software errors: Bugs, database errors, or storage failures may result in loss of saved presets, settings, or figure layouts. We make no guarantee that saved content will persist indefinitely. Export and back up any critical work locally.
  • Rate limiting: To prevent abuse, OmicsPlot applies rate limits to uploads and analysis requests. If you exceed these limits, access may be temporarily blocked. OmicsPlot LLC is not liable for work lost or disrupted as a result of rate limiting.

Data breach notification: In the event of a security incident that compromises personal information as defined under North Carolina G.S. ยง 75-65, we will notify affected users in an expeditious manner consistent with North Carolina law and the legitimate needs of law enforcement. Notification will be provided via email to the address associated with your account, or via a prominent notice on the OmicsPlot website if individual notification is not practicable.

Section 13

Third-Party Infrastructure

OmicsPlot relies on third-party services โ€” including Supabase (database and authentication), GitHub OAuth, Google OAuth, and cloud hosting providers โ€” to deliver the Service. We are not liable for any data loss, exposure, service interruption, or other harm caused by the failure, breach, or unavailability of these third-party services.

Specifically:

  • If Supabase experiences a data breach, outage, or data loss event, OmicsPlot LLC's liability is limited to the actions we take in response โ€” we cannot control or guarantee the security posture of our infrastructure providers.
  • If GitHub or Google OAuth becomes unavailable, you may temporarily be unable to access your account. We are not liable for account access disruptions caused by OAuth provider outages.
  • Third-party services have their own privacy policies and terms of service. Your use of OmicsPlot constitutes acceptance of those third-party terms to the extent that those services are used in delivering the Service to you.

We select third-party providers carefully and require that any provider handling personal data maintain appropriate security standards. However, we cannot guarantee their absolute security or reliability.

Section 14

Exported Files & Downstream Use

When you export a file from OmicsPlot โ€” whether as a PNG, TIFF, PDF, or PowerPoint โ€” that file is delivered to your device and is entirely outside OmicsPlot's control from that point forward. OmicsPlot LLC has no responsibility for:

  • How exported files are used, shared, published, or distributed after download
  • The accuracy or scientific integrity of exported figures if the underlying data was incorrect
  • Any harm arising from sharing, publishing, or submitting exported figures in publications, grant applications, presentations, or any other context
  • Unauthorized access to exported files on your device or in any storage system you use

By exporting a file, you take full responsibility for its accuracy and for any downstream use. You represent that any figure you publish or submit was generated from data you have the right to use and that you have verified its scientific accuracy independently.

Section 15

Force Majeure & Service Availability

OmicsPlot LLC shall not be liable for any failure or delay in providing the Service caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, civil unrest, governmental action, internet infrastructure failures, power outages, cyberattacks on third-party infrastructure, or failures of our hosting or cloud service providers.

We make no guarantee of any specific level of service availability, uptime, or response time. The Service is provided on a best-efforts basis. Planned maintenance, unexpected outages, or service degradation do not constitute a breach of these Terms and do not entitle users to any compensation or remedy.

We will make reasonable efforts to communicate planned downtime in advance via the OmicsPlot website or by email to registered users.

Section 16

Termination

You may stop using OmicsPlot at any time. You may delete your account by contacting us at admin@omicsplot.com. Account deletion removes all associated saved data (presets, settings, sessions) within 30 days.

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, without prior notice or liability. Upon termination, your right to use the Service ceases immediately.

Section 17

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page.

Material changes โ€” including changes to user rights, liability, indemnification, data handling, or permitted use โ€” will be communicated via a prominent notice on the OmicsPlot website for at least 14 days prior to taking effect, and by email to registered users where practicable. Minor clarifications or formatting changes may be made without specific advance notice.

Your continued use of OmicsPlot after changes become effective constitutes your acceptance of the revised Terms.

Section 18

Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
